The government has announced that they are considering increasing the rights grandparents have to see and look after their grandchildren. At the moment, the law says that there is a presumption that a child should have a relationship with both their parents (as long as its in their best interests) but no such presumption exists for grandparents.
As a result, many grandparents have been left feeling excluded from their grandchildren’s lives if their son or daughter has gone through a separation.
But grandparents do have some rights at the moment. If a child is living with their grandparents, and has done so for some time, court applications can be made. Similarly even if the child still lives with mum or dad, grandparents can ask the court for permission to apply for a contact order and will normally be given such permission as long as they can show a genuine interest in and commitment to the child.
