Enoch Evans are Caring for the Community

Christmas is not over for one of Enoch Evans’ clients!

When her client was being assessed for Assisted Living Care benefits by the Local Authority, it came to the attention of Patricia Venables of Enoch Evans’ Probate Department that the Court of Protection held funds for the client. These monies were for personal injury and as such should have been disregarded for means tested benefits.

The Court had previously dealt with the client’s finances. Wolverhampton Council had always taken the compensation monies into account when paying for her nursing care, even though Personal Injury Awards should not be taken into consideration.

After a meeting with her client where the source of these funds became apparent, Patricia requested a reassessment for contribution to her client’s nursing care going back to 2002, to disregard the compensation monies held at the Court. Patricia has now received a cheque for just over £18,000.

Patricia said “It is becoming more apparent that Local Authorities are taking assets that should be disregarded into consideration when assessing the individual for financial contributions towards care. This is happening whether it is care in the community or residential care. The individuals who calculate these assessments are not always fully conversant with which assets must be disregarded
